Terms & Conditions

 The following terms and conditions (Agreement) govern all use of the Enlighten Me Educational Enrichment LLC (collectively, the “EMEE”) website and all content, services and products, including, but not limited to, listings or advertisements of lessons or instructors and the premium service for presenting potential program options to a user. The website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, EMEE Privacy Policy as stated at the bottom of this page) and procedures that may be published from time to time on this site by EMEE (collectively, the “Agreement”). Your agreement is with Enlighten Me Enrichment LLC (a limited liability company).

Please read this Agreement carefully before accessing or using the Website. By accessing or using any part of the Website, you agree to become bound by the terms and conditions of this agreement. If these terms and conditions are considered an offer by EMEE, acceptance is expressly limited to these terms.

A. General conditions.

1.       This Agreement exists as a service to aid students (“Student” or “Students”) using the website, email, or other channels in contacting EMEE.  

2.      Use of the Website is entirely at your own risk. You accept that EMEE is not responsible or liable for any harm or damage that may occur as a result (although we of course aim to minimize any such risk). It is strongly recommended that both Students and instructors familiarize themselves with EMEE safety recommendations before commencing a Tuition Arrangement.

3.      All users and visitors to the Website agree not to promote an external business, product or service to any user or visitor of the Website without the express permission of EMEE.

4.      Any material or links you enter on the Website, or otherwise make (or allow any third party to make) available by means of the Website (any such material, “Content”), you are entirely responsible for the content of, and any harm resulting from, that Content. That is the case regardless of what form the Content takes, which includes, but is not limited to text, photo, video, audio, or code. By making Content available, you represent and warrant that your Content does not violate these terms.

5.      By submitting Content to EMEE for inclusion on the Website, you grant EMEE a world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the Content solely for the purpose of displaying, distributing, and promoting Private, Group Lessons and EMEE in general.

6.      If you delete Content, EMEE will use reasonable efforts to remove it from the Website, but you acknowledge that caching or references to the Content may not be made immediately unavailable.

7.      When you communicate with other users via the Website or otherwise use the functions of the Website, you may submit to us various material, such as the text of any comments and messages submitted by you via the Website (“User Content”). When we receive User Content from you, we may check whether it complies with these Terms. We may reject your User Content for any of the following reasons:

  • If it causes you to breach these Terms including any of your promises as set out in these Terms;

  • For any other reason in our reasonable discretion. Without limiting any of the representations or warranties herein, EMEE has the right (though not the obligation) to, in EMEE sole discretion:

  • Refuse or remove any content that, in EMEE reasonable opinion, violates any EMEE policy or is in any way harmful or objectionable; or

  • Terminate or deny access to and use of the Website to any individual or entity for any reason, in EMEE sole discretion. EMEE will have no obligation to provide a refund of any amounts previously paid.

Withdraws & Refunds

B. Disputes

1.       EMEE can try to arbitrate any dispute arising between a student and an instructor; but, we offer no guarantees in this regard. Please contact us if you have a dispute that you would like us to attempt to arbitrate.

2.      Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of the EMEE services will be governed by the Florida State laws, and the proper venue for any disputes arising out of or relating to any of the same will be within the jurisdiction of the Florida State legal system.

C. Advertisements

1.       EMEE reserves the right to display advertisements, third party or otherwise, on any part of the Website.

D. Photo, Video Usage

1.       EMEE reserves the right to take pictures of students/families participating in classroom, EMEE sponsored events and posted on EMEE websites, flyers, social media, etc.

2.      If you do not want the photos or videos to be posted, please send a written request to emeellc1@gmail.com at the beginning of the semester (within the first two weeks).

E. Changes

1.       Occasionally, we update our services, meaning we sometimes must change the legal terms under which our services are offered. If we make changes that are material, we will let you know by sending you an email or by other communication before the changes take effect.

2.      The notice will designate a reasonable period of time after which the new Terms will take effect. If you disagree with our changes, it may be advisable to discontinue services provided by EMEE within the designated notice period.

3.      Your continued use of EMEE will be subject to the new Terms. However, any dispute that arose before the changes shall be governed by the Terms (including the binding individual arbitration clause) that were in place when the dispute arose.

F. Intellectual Property

Without prior approval and written permission, you may not create frames around the EMEE web pages that alter in any way the visual presentation or appearance of our website.

G. Termination

1.       All provisions of this Agreement which by their nature should survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

H. Limitation of Liability

1.       In no event will EMEE, or its staff, and/or employees, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for:

  • Any special, incidental or consequential damages;

  • The cost of procurement for substitute products or services;

  • For interruption of use or loss or corruption of data; or

  • For any amounts that exceed the fees paid by you to EMEE under this agreement during the twelve (12) month period prior to the cause of action.

2. If you wish to terminate this Agreement or your EMEE account (if you have one), you may simply discontinue using the Website.

3. EMEE shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

I. General Representation and Warranty

1.   You represent and warrant that:

  • Your use of the website will be in strict accordance with EMEE Privacy Policy below, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside);

  • Your use of the website will not infringe or misappropriate the intellectual property rights of any third party.

J. Indemnification

1.       You agree to indemnify and hold harmless EMEE, its respective directors, officers, employees and agents from and against any and all claims and expenses, including legal fees, arising out of your use of the Website, including but not limited to your violation of this Agreement.

K. Translation

1.       These Agreement was originally written in English. We may translate these Terms into other languages. In the event of a conflict between a translated version of this Agreements and the English version, the English version will control.

L. Miscellaneous

1.       This Agreement constitutes the entire agreement between EMEE and you concerning the subject matter hereof, and they may only be modified by a written amendment signed by an authorized executive of EMEE, or by the posting by EMEE of a revised version.

2.      The prevailing party in any action or proceeding to enforce this Agreement shall be entitled to costs and legal fees.

3.      If any part of this Agreement is held invalid or unenforceable, that part will be construed to reflect the parties’ original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition of this Agreement or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof.

4.      You may assign your rights under this Agreement to any party that consents to, and agrees to be bound by, its terms and conditions; EMEE may assign its rights under this Agreement without condition. This Agreement will be binding upon and will inure to the benefit of the parties, their successors and permitted assigns.

 Terms and Conditions

Enlighten Me Educational Enrichment (EMEE) reserves the right to cancel or re-schedule any course if a minimum number of participants do not register within the specified time frame. In the event of a cancellation or re-scheduling by Enlighten Me Educational Enrichment, all received funds will be returned within 7 days of the first day of the cancelled course. Every effort will be made to make sure that any cancellation or re-scheduling notifications are received by the registrant prior to the course. E-mail or other used notification app(s) will be the primary medium for these notifications unless the registrant did not include an email address EMEE-associated mode of communication with the registration.

All registrations are accepted on a first paid, first served basis. Registration fee may be returned/refunded if the class is full or if cancelled due to course minimum not being met.

Tuition Payments

All payments are due before services are rendered. Late payments are subject to a $10.00 late fee per student. Payments can be paid via credit card, debit card, or ACH through the EMEE website’s app.  For in-person visits, credit card, debit cards, ACH, and cash payments are accepted.  For academic workshops, payments can be made by cash, card, and bank checks (payable to Enlighten Me Educational Enrichment, LLC). 

Please send all inquiries to Enlighten Me’s mailing address on the site’s app to emeellc1@gmail.com. We do not prorate for absences or by the hour. It is at the discretion of EMEE’s owner to determine a change in the terms of agreement based on a student’s extenuating or unforeseen circumstances.  

After one withdrawal or two cancellations, it is at the owner’s discretion to consult with the student and/or designated payee about a plan to maintain continuation or cancellation of services.  For academic workshops, if a student is withdrawn, and that the Program has a waitlist, and the student WILL lose the spot. EMEE does not hold spaces for student enrollment into all provided services under any circumstances.

Cancellation Policy                                                                        

All students and/or designated payees that signed the EMEE contract are subject to this cancellation policy.

  • All participants, parents, and/or guardians acknowledge and accept many factors impact the level of student success that can be achieved in the educational process. As a result, specific results cannot be guaranteed.

  • All participants, parents, and/or guardians acknowledge and accept if the student fails to call/appear within the first fifteen (15) minutes of the appointment time or cancels with less than a twenty-four (24) hour notice, the tutor has the right to cancel and student forfeits one (1) hour of instruction.

  • All participants, parents, and/or guardians acknowledge and accept if the instructor fails to call/appear within the first 15 minutes of the appointment time or cancels with less than twenty-four (24) hour notice, the student will be granted one (1) hour of instruction at the tutor’s earliest convenience. 

  • All participants, parents, and/or guardians acknowledge and accept that no refunds will be granted after completion of the first tutoring appointment.

  • All participants, parents, and/or guardians acknowledge and accept this tutoring contract may be terminated by either party at any time by giving the other party seven (7) days prior written notice.

  • All participants, parents, and/or guardians acknowledge and accept no relaxation, indulgence, waiver or release by any party of such rights in terms of this agreement on one occasion shall prevent the subsequent enforcement of such rights in the future and shall not be deemed to waive subsequent breaches.

  • All participants, parents, and/or guardians acknowledge and accept this agreement constitutes total understanding between parties regarding the subject matter. Both parties confirm that no other representations or promises, beyond those stated here, were relied upon. Amendments must be in writing and signed by parties.

  • All participants, parents, and/or guardians acknowledge and accept if the student is a legal minor, the parent/guardian shall enter into this tutoring contract on behalf of the student and shall accept and agree to all the terms and conditions contained herein on behalf of the student.
